Importer Security Filing (10 +2) Interim Rule Information
On November 25, 2008, U.S. Customs and Border Protection (CBP) published in the Federal Register an interim rule for the Importer Security Filing (ISF), also known as 10 + 2. Because of concerns from both trade partners and Congress concerning the complexity and cost, CBP has issued the rule as an interim, accepting comments and reviewing the process during the interim period. The interim rule will go into effect January 25, 2009. Actual enforcement of the rule’s requirements will be delayed for a period of one year, providing filers make satisfactory progress toward compliance with the rule. Comments must be received by CBP on or before June 1, 2009.

There are several tiers of service available to importers supporting various levels of automation.
Tier 1 - Web Data Entry:
Importer or their designated user will manually key all of the required data into our IS application and MTS will submit to CBP.
Tier 2 - Data Feed (xml, csv):
Importer or other designated party will send MTS all of the required data in one (1) file via FTP.
Tier 3 - Customized Solution:
Importer is currently sending data to MTS and will append existing interface with missing required data, or will send an additional interface to be matched to existing data. MTS will consolidate data and submit to CBP.
Tier 4 - Customized Solution:
Importer is NOT currently sending data to MTS but would like to send data for IS filing in a different format than highlighted in Tier 2 (i.e. invoice) and will send missing data in a different file feed.

US Container Seal Requirement Takes Effect Oct.15
Effective October 15th; U.S. Customs and Border Protection has announced that all loaded containers, including foreign cargo remaining on board, arriving by vessel at a port of entry in the U.S. on or after Oct. 15 are required to be sealed with a seal meeting the International Organization for Standardization Publicly Available Specification 17712 standard. This standard is being imposed pursuant to the Implementing Recommendations of the 9/11 Commission Act of 2007 because the Department of Homeland Security did not issue by April 1, 2008, an interim final rule establishing minimum standards and procedures for securing containers in transit to the U.S.
CBP will consider loaded containers subject to the sealing requirements to be in violation of the 9/11 Act if they arrive by vessel at a port of entry in the U.S. on or after Oct. 15 with either no seal or a seal that does not meet the ISO/PAS 17712 standard. In such cases CBP may assess a civil penalty against the party responsible for the violation for the attempted introduction of merchandise into the U.S. contrary to law. However, CBP states that it will phase in penalty assessments for such violations. CBP is also reminding vessel carriers that they must transmit all seal numbers via the Vessel Automated Manifest System 24 hours before cargo is laden aboard a vessel at a foreign port.

C-TPAT Receiving of containers - important notice.
A recent validation meeting with a C-TPAT Certified company and CBP illuminated a serious issue regarding the receiving of sealed containers into US warehouses. It is imperative for security that the seal number of the container is available to the receiving warehouse before the container arrives. The seal number can be originally inserted on any pre-doc, such as an original bill of lading, load document, etc. that is in the possession of the receiving party. When the container arrives at the unloading dock, this pre-supplied seal number must be compared and matched with the actual seal number of the seal on the container. If there is a discrepancy, CBP must be notified before the seal is broken.
